HomeMy WebLinkAboutOrdinance 0028 e e e ORDINANCE NO. 21" AN ORDINANCE TO BE ENTITLED AN ACT TO PROHIBIT DISTURBING THE PEACE, DRUNKENNESS OR INTOXICATION, AND TRESPASSING ON PRIVATE PROPERTY AND PREMISES, DEFINING CERTAIN TERMS, PRESCRIBING PENALTIES, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS: SECTION I DISTURBING THE PEACE (a) If any person shall go into or near any public place or into or near any private house, and shall use loud, vociferous or obscene, vulgar or indecent language, or swear or curse or yell or shriek or expose his person, or display any pistol or other deadly weapon, in a manner calculated to disturb the inhabitants of such pub I i c p I ace, 0 r p r i vat e h 0 use, he s h a I I beg u i I t y 0 f ami s d e me a nor. ( b ) A II pub I i c p I ace" wit h i nth e me ani n g 0 f t his s e c t ion ¡sa n y publ ic road, street or al ley of the city, or any inn, tavern, store, grocery or workshop, or place, at which people are assembled, or to which people commonly resort for purposes of business, amusement, recreation or other lawful purposes. SECTION II DRUNKENNESS OR INTOXICATION (a) Any person who shall get drunk or shall be found in a state of intoxication in any pub) ic place shall be deemed guilty of a misdemeanor. (b) The term "publ ic place" is defined as set forth in sub- paragraph (b) of Section I hereof. SECTION III TRESPASSING ON PRIVATE PROPERTY (a) It sha11 be unlawful for any person to trespass upon the property of another without the consent of the owner thereof, and ~ any person so doing shall be deemed guilty of a misdemeanor. (b) By the word "property" as used in this section is meant and defined to be any kind or character of property, real or personal, whatsoever. - .. e SECTION IV TRESPASSING ON PRIVATE PREMISES (a) It shall be unlawful for any person to trespass, to enter, or to intrude upon the premises of another without his consent, and any person so doing shall be deemed guilty of a misdemeanor. (b) By the word "premises" as used in this section is meant and defined to be real property, specifically including any struc- tures thereon. e SECTION V SAVINGS CLAUSE If any section, sentence, clause or part of this ordinance is for any reason held to be invalid, such decision shall not effect the remaining portions of this ordinance,the Council hereby declar- ,ng that it would have passed this ordinance and each sentence, clause and part thereof despite the fact that one or more sections, sentences, clauses, or parts thereof be declared inval id. SECTION VI PENALTY Any person guilty of committing any of the foregoing offenses shall be punished by fine of not to exceed $100.00. e SECTION VI J EMERGENCY The fact that the city has no ordinance prohibiting the acts herein condemned, and that such acts should be prohibited in the i n t ere s t 0 f the g e n era I pub I i c we I far e, c rea t e san erne r g e n c y and imperative publ ic necessity that this ordinance be passed and become effective immediately upon publ ication, requires the suspension of any rule requiring that ordinances be read at three several meetings be suspended, and any such requirement is hereby suspended, and this ord inance shall be effect ive from and after publ icat ion. / Â~...,* "18. ~.
