HomeMy WebLinkAboutResolution 1990-034 RESOLUTION NO. 90-34 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, that: The Mayor be, and is hereby, authorized to execute the inter local agreement between the City of North Richland Hills and Tarrant County concerning the Industrial Park Boulevard East street and drainage improvements from Holiday Lane north and west to Industrial Park Boulevard, a copy of which is attached to this resolution, as the act and deed of the City of North Richland Hills. APPROVED: Tommy Brown, ATTEST: APPROVED AS TO FORM p-- Re~:& for the City l (; ( THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT CONTRACT This Agreement made and entered into this the ~ day of I.~~\LQ t ' 1990, by and between the County of Tarrant, ... ~ acting herein by and through its governing body the Commissioners' Court, hereinafter referred to as TARRANT COUNTY, and the City of North Richland Hills acting herein by and through its governing body, hereinafter referred to as THE CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made pursuant to and in strict compliance with the provisions and dictates of Article 4413 (32c) V.T.C.S., more particularly known as the INTERLOCAL COOPERATION ACT; and WHEREAS, the party or parties paying for the performance of governmental functions or services shall make payments therefor from current revenues available to the paying party; and WHEREAS, the governing bodies of the two parties find that the project or undertaking is necessary for the benefit of the public and that each party has the legal authority to build or maintain the project or to provide such service, and the construction and improvement thereof is in the common interest of both parties hereto; and that the division of costs provided for constitutes adequate consideration to each party; set project being more particularly described as: o Construction of Industrial Park Boulevard East for approximately 1500 feet from Holiday Lane North and West to Industrial Park Blvd. East. WHEREAS, the CITY agrees that it is solely responsible for the furnishing of flag-man and all warning devices necessary, or required by law, to warn the public of dangers in connectioll with the premises and/or the work being performed under this agreement. WHEREAS, the parties hereto, in order to facilitate the financing and construction of the needed facility, and in order to share the costs of having said work to be done have agreed to share COpy detail. in the financing of said construction as hereinafter stated in , For and in consideration of the mutual undertaking hereinafter as follows: set forth and for adequate consideration given, the parties agree 1. Tarrant County agrees to reconstruct Industrial Park Boulevard East for a distance of approximately 1500 feet from Holiday Lane North and West to Industrial Blvd. East.
