HomeMy WebLinkAboutOrdinance 0195 ORDINANCE NO. 195 An Ordinance of the City of North Richland Hills I Texas, providing subdivision regulations for the platting and developing of subdivisions within the limits of the City of North Richland Hills and for such other areas as may be authorized by State Statutes; providing a severability clause; and pro- viding the effective date ~ WHEREAS, the present rules and regulations of the City of North Richland Hills regulating the platting and developing of subdivisions are inadequate to protect the publìc interest; and WHEREASç after holding public hearings as stipulated by the Charter of the City! it is the opinion of the City Council of the City of North Rich- land Hills that the following subdivision regulations should be adopted; NOW THEREFORE be it ordained by the Cìty Councìl of the City of North Richland Hills that the attached Subdivision Regulations be and the same are hereby adopted as the Rules and Regulations for the platting and subdivision of land within the City of North Richland Hills and its extra- territorìal jurisdiction. Conflict with Other Ordinances Vvhenever the standards and specifications in this Ordinance conflict vVith those contained in another Ordinance s the most stringent or restrictive provision shall govern.. Severabilit;( Clause Should any portion or pôrt of this Ordinance be held for any reason in- valid or unenforcible s the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect. Effective Tirne and Status (A) Undivided areas where no preliminary plat has been endorsed by the Commission or Council a.nd no plats are filed of record - complete compliance. (B) Areas where preliminary plat has been approved as evidenced by copy endorsed by Cornmission or Councils but parts or whole not yet filed of record - approval status will stand and existing variances will be identifìed and granted by the Commission ôt the time of passage of this Ordinance $ All subsequent actions to comply 'N:ith this Ordinance except as excused by the specific variances. 1 (C) Areas that have been: filed of record but site irnproveffients (other than excavation) that have not been commenced and are not under contract dated prior' to passage of this Ordinance; applicable portions of Ordinance tQ apply I partioularly all sections of Volumes II and Ill. B .. PU RP~SE The purpose of this Ordinance is to prqviçie for the orderly I safe and healthfu.l development of thearøa within the City and. within the area surround- tog the City and to promote the h,ealth I safety and general welfare of the com- munity. G ~ DEfINITIONS For the purpose of this Ordinance t the following tenns f phrases I words f and other derivations shall have the meaning asçribed to them in this section: Alley; A minor public right-of-way t not intended to provide the primary means of access to abutting lots I which is used primarily for vehicular service access to the back or sides of properties other- wise abutting Qn a street. BuHditk9Setback Line: The line within a property defining the minimum horizontal distance between a building or other structure over 241\ high and the adjacent street line. City; The City of NQrth PJohland Hills I Texas to Commis siQ.!l.; The Planning and Zoning Commis 810n of the City ~ Crosswalk Way: 1\ public right-of-way I four (4) feet or more in width between property lines, which provides pedestrian circula- ti on s .. Cul-de-sac: .A street having but ope outlet to another street I and terminated on the opposite end by a vehicular turn-around. Dead-End Street: one outlet.. A street I other than a cui-de-sac.. with only Enqineer: A person duly authorized under the provisions of the 4 Texas Engineering Registration Act, as heretofore or hereafter amended i to practice the profession of ~ngineering. The term !~Gity Engineerll shall apply only to sµch Registered Professional Engineer or firm of Registered Professional Consulting Engineers that has been specifically designated as such by Resolution of the Cíty Council.. Pinal Plat: (Also Record Plat or Filing Plat) The one official and auth~ntic map of any given subdivision of land pre- pared from actual field measurement and staking of all identifiable points by a Surveyor or Engineer with the subdivision location referenced to a survey corner and all bQundaries i corners and curves of the land division sufficiently described so tha t they can be re- produced withoµt additional references. Angular measurements and bearings shall be accurate to the nearest minute. Distances shall be accurate to the nearest tenth of a foot. ~~nd,I;+anner: Persons other than Surveyors or Engineers who also possess and can demol1strate a valid proficiency,trfthe planning of residential,· commercial, tndustrial and other related. developments; such proficiency often having been acquired. by education in the field of landscape architecture or other speci~Üized planrlÍng curriculum and/or by actual experience and practice in the field, of land planning. Lot: An undivided tract or parcel of land having frontage on a public street and which is i or in the future may be offered for sale f conveyance, transfer or improvement; which is designated as a distinct and separate tract, àpd which is identified by a tract or lot number or symbol in a du.ly approved subdivision platvvhich has been propfqrly filed Qf record.. Pavement 'NidthJ The portion of a street available for vehìçular traffic. \Vhere curbs are laid I it is the portion between the face of curb. Person: Any individuaL association i firm i corpora tion f governmental agency, or pplitical subdivision~ Preliminary Plati (Also Preliminary Development Study I Overall Plan of Development f eta.) The graphic expression of the proposed overall plan for $ubdivìding I improving and developing a tract sho'Nn by superimposing a scale drawing of the proposed land division on a topo- graphic map and showing in plan existing and proposed drainage featw.res and facilities j street layout and direction of curb flow, and other pertinent features with nQtations sufficient to substantially identify the general scope and detail of proposed development. The word Itmaytt is merely directory. 5 Sketch Plan: A sketch çlrawing of initial development ideas superimposed Qrl a tQpographic map to indicate generally the plan of development andto serve as a working base for noting and ìncorpora- tìng$uggestions of the City Manager.. Commission.. Engineer or others who are consulted prior to the preparation of the preliminary plaL Street: A public right-af-way I hovvever designated ¡ which provides vehicular access to adjacent land.. (1) lvlajor thoroughfares (also Arteríal Streets, Primary thQroughfa res I etc..) provide vehicula r movement from one neighborhood to another ç to distant points within the Urban Area or to Freeways or Highways leading to other cQmmuniti~s .. (2) CQllector Streets (also Feeder Streets I Secondary thoroughfares, ete..) provide vehicular circulation within neighborhoods and from rninor streets to major thoroughfares.. Due to similarity of traffic volume and wheel loadings t streets through commercial. and industrial areas are frequently constructed to same design as Collector Streets ~ (3) Local ResidentialStreets (also t'.4inor Thoroughfares or Streets t etc.) are. primarily for providing direct vehicular access to abutting residential property.. Subdivider: Any person or any agent thereof, dividing or proposing to divide land so as to constitute a subdivision as that term is defined herein. In any event I the term II subdividerH shall be restricted tQ include Qnly the owner t equitable owner or authorized agent of such owner or equitable owner lpflp:nçlsought .to.be·subdivided. Subdivision: A division of any tract of land situated vv-ìthin the corporate limits ( or within the extra-territorial jurisdiction of such limits, in two or more parts for the purpose of laying out any sub- division of any tract Qf land or any addition of any town or city I or for laying out sl.1þuTban lots ;or building lots I or any lots and streets, alleys or parts Örother portions intended for public use or the use of purchasers or owners of lots frQnting thereon or adjacent thereto. Sub- division includes re-subdivision¡ but it does not include the division of land fQr agricultural purposes in parcels or tracts of five (5) acres or more and not involving any new street.. alley or easement of access. ªµfVeYQr~ A licensed State Land Surveyor or a Registered Public Surveyor.. as authorized by the State statutes to practice the profession of surveying. 6 Utility Easement: An interest in land granted to the City I to the public generally I and/or t~ q private utíUty corporation¡ for installing and maintaining utilities across ,over or under private land, togather vvith the right to enter thereon with machinery and vehicles necessary for the maintenance of said utilities.. Any office referred to in this Ordinance by title means the person employed or appointed by the City in that PQsition, or his duly authorized representative" Definitions not expressly prescribed herein are to be construed in &coordance with customaty usage in municipal planning and engineering prac- tic~s . D. SPEOIAL PROVISIONS 1.. NQ permit ;shall be issued by the City for the installation of septic tanks upon any lot in a subdivision for which a final plat has not been approved and fHed for record, or upon any lot in a subdivision in which the standards contained herein or referred to herein have not been complied wìth in full. 2. No building ¥ repair, plumbing or electrical permit shall be issued by the City for any structure on a lot in a subdivision for which a final plat has not been approved and filed for record t nor for any structure on a lot within a subdivision in v¡hich the standards contained herein or referred to herein have not been oomplied vJ:ith in full. 3.. The City Manager and the City Engineer may allow sectional development of an approved final plat prQvided that the section of the final plat meats all the requirements of this Ordinance in full as though it were a s\,tbdivision \'Y'ithil1 itself. 4.. The City shaH not authorize any other p(~rson nor shall the City itself repair I maintain I install or provide any streets or public utility services in any subdivision for whiç h the standards contained herein or referred to herein have not been complied with in full. 5 ~ The City shall not authorize any other pers on nor shall the Oity Hs§?Jl.sel1 Or supply any water ç gas¡ electricity I or sewerage service within a subdivision for which a final plat has not been approved or filed for record I nor in which the standards contained herein or referred to herein have not been complied with in full.. p. In behalf of the City t the City Attorney sha 11, when directed by the City CounqiL institute appropriate action in a court of competent jurisdiçtion to enfQrce the provisions of this Ordinance or the standards referfed to herein with respect to any violation thereof which occurs within the City I within the extra-territorial jurisdiction of the City as such juris- dictiQn is determined under the I\1unicipal Annexation Act, or within any area subject to all or a pflrt of the provisions of this Ordinance. 7 7 .. No str~et shall be more than 1,000 feet in length without an intersection with another street which will provide some degree of flexi- bility in traffiçpattems and public convenience. 8. Street signs shall be paid for by the Developer at the rate established by the City Council at the time the final platfHin9 fees are paid. 9. If any subdivision exists for which a fina 1. plat has not been approved or in which ~þe standards contained herein or referred to herein have not been complied with in full, the City Council of the City shall pa s s a resolution reciting the fact that such non-compliance or failure to secure final plat approval, and reciting the fact that the provisions of paragraphs 1, 2, 4 and 5 of this Section will apply to the subdivision. and the lots therein. The City Secretary shall, vlhen directed by the GHy Council 0 f the City I cause a certified copy of such resolution under the corporate seal of the City to be filed in the Deed Records of the County or Counties in which such sub- division or part thereof lieG. If full compliance and final plat approval are secured after the filing of $uch resolution, the City Secretary shall forthwith file an instrument I in the D$ed Records of such county or counties stating that Paragraph 1, 2 t 4 and 5 no longer apply. 10. The provisions of this Section shaH not be construed to pro- hibit the issuance of permits to any lQts upon which a residence building exists and was in existence prior to passage of this subdivision ordinance I or to prohibit the repair I maintenance or installation of any street or public utility services for any residential building I or abutting any sale lot, the last recorded conveyance of which priQr to passage of this Ordinance was by metes and bounds I and/or any subdivision, or lot thereint recorded or un- recorded t which subdivision was in existence prior to the passage of this Ordinance. E. IMPROVEMENTS The subdivider shall furnish, inst&ll and/or COnstruct the water and sewerage systems and the street and drainage facilities neces sary for the proper devßlopmentof the subdivision. All such facilities shall be designed and constructed in accordance with Volumes II and III of this Ordinance. Where considered neces sary by the City Engineer I the facilities shall be sized in excess of that dictated by the design criteria in Volume II to provide for future growthan.d expausion~ The City Councí1 shall establish policies whereby the City would participate in such oversized facilities provided funds are available. r VARIANCES The Planning and Zoning Commission may recommend and the City Councl1 may authorize a variance from these subdivision regulations vvhen, in its opinionl undue hardship will result from requiring strict compliance. 8 In granting a variànçe¡ the Council shall prescribe only conditions that it deems necessary~ to Or desirable in the public interest. In making the findings herein below required t the Council shall taka into account the nature of the proposed U$B of the land involved.. existing uses of land in the vicinity ¡the number of persons who will foside or work in. the proposed subdivisiqn.. and the probable effect of such variance upon traffic condi- tions and upon the public health¡ safety i cOnvenience and welfare in the 'vicinity. No variance sha 11 be granted unl~s s the Council finds: L That there are special circumstances or conditions affect- ing the land involved such that the ~trict application of the provisions of this Ordinance wou~d deprive the applicant of the reasonable use of his land; and 2" That the variance is necessary for the presen1ation and enjoyment of a substantial property right of the applicant; and 3" That the granting of the variance will not be detrimental to the public haa lth f sa fety or vve lfa fe t qr inj UrlOU s to other property in the area; and' 4.. That the grq,nting of the variance will not have the effect of preventing the orderly subdivision of oth\?f land in the area in accordance with the provisions of this ordinance.. Such finds of the Council¡ together with the specific facts upon which such findings are based t shall be 1n- corpQratedinto the official minutes of the Council meeting at which such variance i$ granted,. Variances may be granted only when in harmony with the general purpose and intent of this Ordinance so that the public health, safety and welfare may be secured and substantial justice done. Pecuniary hardship to ~he subdivider, standing alone I shall not be deemed to constitute undue hardship.. 9 SECTION 1-02 SKETCH PLAN AND PRELIM¡NARY CONFERENCE A. SKETCH PLAN Prior to the official filing of a preliminary plan t the subdivtder sha 11 avail himself of a copy of the Subdiv~$ion Reguh3. tions and should present a sketch plan, as shown on the followipg page I of the proposed subdivision to the. City Iv1anager for comments and aðvice on procedurøs, specifications dnd standards required by the City for the subdivision of land. Prepara- tion and presentation of the sketch plan is not mandatory and no approvals¡ either tentative or final/will be given Qn sketch plans ; however/ their preparation is recommended as an economy measure to facilitate the inclu- sion of requir~ments and suggcstions prior to gotng to the expense of design- ing aµd drafting the pré1iminary plan.. B.. PRELIMINARY CONFERENCE , At the tirtle the sketch plan is presented to the City rv1anagcf, a preliminary conference should be held for the general comments and clarifi- cations which are usually necessary.
