CALL TO ORDER The meeting was called to order by Chairman Don Bowen at 7:00 p.m. 2. RECONSIDERATION OF MINUTES OF AUGUST 26, 1999 APPROVED Mr. Blue, seconded by Mr. Welch, moved to approve the minutes of August 26, 1999. The motion carried unanimously. Page 1 9/9/99 P & Z Minutes 4. PS 99-23 CONSIDER REQUEST OF PAO L Y FOR A PRELIMINARY PLAT OF LOT 1, BLOCK 1, L Y ADDITION. THIS PROPERTY IS LOCATED IN THE 8900 BLOCK OF RUMFIELD ROAD. APPROVED Ms. Ratcliff explained that the applicant is requesting to plat two lots along the north side of Rumfield Road, across from the Eden Road intersection. The property contains 2.56 acres and is zoned R1S-Special Single Family Residential. Staff recommends approval of PS 99-23 subject to engineer's comments regarding engineering and construction plans. Mr. Nehring, seconded by Mr. Tolbert, moved to approve PS 99-23 subject to engineer's comments regarding engineering and construction plans. The motion carried unanimously. Page 2 9/9/99 P & Z Minutes 5. PS-99-28 CONSIDER REQUEST OF ALAN CURLEE FOR A REPLA T TO BE KNOWN AS LOTS 2A & 2B, BLOCK 1, NOB HILL NORTH ADDITION. THIS PROPERTY IS LOCATED AT 9288 HUNTINGTON SQUARE. APPROVED Ms. Ratcliff summarized the case, explaining that the request is to subdivide Lot 2, which contains .63 acres, into two lots. The property is zoned 01-0ffice and the Comprehensive Land Use Plan designates it commercial. Ms. Ratcliff stated that staff recommends the P&Z approve PS 99-28 subject to engineer's comments regarding engineering and construction plans. Mr. Davis, seconded by Mr. Blue, moved to approve PS 99-28 subject to engineer's comments regarding engineering and construction plans. The motion carried unanimously. Page 3 9/9/99 P & Z Minutes 6. PZ 99-21 SITE PLAN APPROVAL FOR COMMERCIAL DEVELOPMENT LOCATED WITHIN 200' OF RESIDENTIALLY ZONED PROPERTY ON PROPERTY TO BE KNOWN AS LOTS 2A & 2B, BLOCK 1, NOB HILL NORTH ADDITION. THIS PROPERTY IS LOCATED AT 9288 HUNTINGTON SQUARE. Ms. Ratcliff explained that this site plan request is running concurrently with a replat of this lot, which contains 14,672 square feet and is zoned 01-0ffice. Because this property is within 200' of residentially zoned property, site plan approval is required. She explained that because of existing improvements and their necessity to the developed parcels, the site does not meet the requirements of the landscape regulations and the applicant has submitted an application for a variance to the landscape regulations. Staff recommends approval of this site plan, contingent upon the approval of the variance to the Landscape Ordinance. Mr. Welch, seconded by Mr. Blue, moved to approve PZ 99-21, subject to approval of LRC 99-06 being approved by the City Council. The motion carried unanimously. Page 4 9/9/99 P & Z Minutes 9. PZ 99-22 PUBLIC HEARING TO CONSIDER THE REQUEST OF SERVICE KING FOR A SPECIAL USE PERMIT TO ALLOW AUTO GLASS REPLACEMENT AND PAINTLESS DENT REPAIR ON LOT 17, BLOCK 20, SNOW HEIGHTS ADDITION. THIS PROPERTY IS LOCATED AT 6920 NE LOOP 820 DENIED Ms. Ratcliff explained that the applicant is requesting a special Use Permit to allow auto glass replacement and paintless dent repair at a facility currently under construction. Service King's original intention for the facility was to conduct collision repair estimates while actual repairs would be done at another location. Ms. Ratcliff explained that staff recommends denial of this request, explaining that if this facility would have been developed with the intention of conducting repairs, staff would have required additional buffering from the residences to the south. Chairman Bowen opened the public hearing and called the applicant forward. Mr. Eddie Lennox presented this request, explaining the original intention for the facility was for collision repair estimates, an insurance company & adjuster; however, that deal has fallen through. They now propose auto glass replacement and paintless dent repair for vehicles. He stated there are no compressors used and no loud noise would be generated. He believes the cars sitting in line at the drive thru of the neighboring bank would generate more noise and fumes in a day than this facility. Seeing no additional proponents, and no opponents, the public hearing was closed. The general consensus of the Commission was that the use wasn't compatible to single family residential and wouldn't be fair to the citizens abutting this property. Mr. Davis, seconded by Mr. Nehring, moved to deny PZ 99-22. The motion carried unanimously. Mr. Lennox was informed that he had 10 days to appeal the P&Z's decision to the City Council. Page 5 9/9/99 P & Z Minutes 8. PZ 99-24 PUBLIC HEARING TO CONSIDER THE REQUEST OF TOMMY TUCKER FOR A ZONING CHANGE FROM LR-LOCAL RETAIL TO C2-COMMERCIAL ON LOT 2, JOHNS ADDITION. THIS PROPERTY IS LOCATED AT 6400 DAVIS BOULEVARD. Ms. Ratcliff gave an overview of the case, explaining that this existing service station, which has been in existence for over 40 years, is located in a district that is currently zoned LR-Local Retail. It is the only parcel in that area zoned as such, explaining that the property north and east of this is zoned C2-Commercial; the property to the west, across Davis Blvd., is zoned 12-lndustrial and the property to the south is an SUP. Ms. Ratcliff explained that staff recommends approval of this request, which would allow the existing service station to operate as a conforming use. Chairman Bowen opened the public hearing and called the applicant forward. Mr. Tommy Tucker presented his request and showed pictures of his station when it first opened about 50 years ago and showed pictures of the current facility, explaining that he is trying to catch up with the times. He plans on adding an additional bay for state inspections; the existing bays would remain for service repairs. Seeing no proponents or opponents, the public hearing was closed. Mr. Blue, seconded by Mr. Laubacher, moved to approve PZ 99-24, as requested. The motion carried unanimously. Page 6 9/9/99 P & Z Minutes 9. REVIEW, DISCUSS AND CONSIDER AUTHORIZING A PUBLIC HEARING TO CONSIDER AMENDING ZONING ORDINANCE NO. 1874, RELATIVE TO SCREENING REQUIREMENTS, SPECIAL LAND USE REGULATIONS, SUPPLEMENTARY DISTRICT REGULATIONS, DEFINITIONS AND PARKING AND LOADING RECOMMENDATIONS. Ms. Ratcliff explained that Dan Sefko, Dunkin, Sefko & Associates would be making a presentation on proposed changes to the Zoning Ordinance and Subdivision Regulations. She asked that after the presentation the Commissioners could discuss the recommended revisions and any additions or deletions they may desire. Should the proposals be acceptable, the Commissioners could schedule a public hearing to begin the adoption process. Mr. Sefko made a PowerPoint presentation on Recommended Changes, first to the Subdivision Regulations, which included: .:. Alternatives for Article 3, Section 355; Height Specifications, Living Screens with an Approved Plant List, Screening Fences and Definitions of Screening and Masonry. Suggested revisions for the Zoning Ordinance included: .:. Revisions to Article 10, Section 1020 & 1 020.C - Screening Requirements .:. Revisions to Article 3, Section 320, sub-section 17 - Rewrite for Article 10 Screening Requirements for Outdoor Waste Disposal/ Refuse Areas .:. Revisions to Article 310 - Clarify Table of Permitted Uses .:. Article 4, Section 440, Sub-Section C - Increase Minimum Side Yard Setbacks .:. Article 11, Definitions - Screening, Masonry, Outdoor/Outside Storage, Outside Display .:. Article 6, Section 600.A -Increase Masonry Requirements for Residential Uses .:. Article 6, Section 600.B - Revision to Masonry Calculations, allow for unusual construction or other materials with a Special Use Provision .:. Article 6, Section 605.A -Increase Masonry Requirement for all Non- Residential Uses, alter Table 6-2, Establish a Minimum Pitch Ratio .:. Revision to Article 8 - All New Residential Construction to Require at Least Two Covered and Enclosed Parking Spaces Per Unit .:. Revisions to Article 6 - Outdoor Storage and Display Requirements .:. Addition to Article 6 - Architectural Requirements - Add Facade Offset Requirement. Discussion among the Commissioners, Staff and Mr. Sefko ensued and the Commissioners asked that, with minor changes, a draft ordinance be prepared Page 7 9/9/99 P & Z Minutes for their review. The Commissioners wanted the opportunity to review the draft ordinance prior to scheduling public hearing. Staff stated they would have the draft ordinances for the Commission's review on October 14, 1999. Page 8 9/9/99 P & Z Minutes 10. MISCELLANEOUS REPORTS Staff requested to the Planning and Zoning Commission to reschedule the October 28, 1999 meeting due to schedule conflict for a reception for all the Boards. The Commission agreed to reschedule the meeting to October 26, 1999. The Commission also looked at the December 23,1999. The Commission agreed to cancel that meeting date due to the holidays. 11.
