HomeMy WebLinkAboutResolution 1978-025 RESOLUTION NO. 78-14 A RESOLUTION AUTHORIZING A CONTRACT FOR TRAFFIC SIGNAL MAINTENANCE. WHEREAS, the City of North Richland Hills does not have trained personnel and it is not feasible to hire trained personnel to properly maintain its traffic control systems, and WHEREAS, it is deemed in the best interest of the City that the City enter into a "Traffic Signal Maintenance Agreementll with an outside contractor who has the necessary equipment and trained manpower to properly maintain the City's traffic control systems, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, that the Mayor, on behalf of the City, be authorized to enter into a traffic signal maintenance agreement with Traffic Signal Control Company of Mesquite, Texas, on the terms and conditions contained in the memorandum dated September 13, 1978, from Ray H. Recommend that the City of North Richland Hills, Texas, enter into a contract agreement with Traffic Signal Control Company of Mesquite, Texas, for maintenance of traffic control signals at the following lrications: 1)1---- ~ a. Contract to be for a period of 12 months beginning 1 October, 1978, with the City having the option of renewing the contract for additional twelve (12) month periods on successive anniversary dates. b. Cost of maintenance service to be paid monthly at the rate of $350.00 per month. c. Cancellation for failure to carry out the terms and conditions of this , contract upon 30 days written noti ce. III. Conditions: a. Contractor agrees to provide all parts and labor to maintain traffic signal equipment at locations in paragraph I in excellent and proper operating condition except for lamps and installation, underground wiring, pole paint- ing, loops in pavement, loop detectors damaged by lighting conductors or lightning, damage from vandalism, vehicle or aircraft collision or acts of God. b. Contractor will repair or replace loop detectors and controller components damaged by lightning at his prevailing hourly labor rate plus his cost for parts and/or detectors. c. Contractor agrees to respond to all requests for traffic signal maintenance with the least possible delay, but in no event will delay exceed three hours from the time of notification to telephone number designated. It is agreed that this paragraph provides for 24 hour, 7 day a week traffic signal maint- enance. d. Contractor agrees to perform inspection and any required maintenance (except for lamp replacement) for traffic signal equipment at locations in paragraph I bi -weekly. Contractor agrees to provide estimate of cost to repair traffic signal equipment damaged by collision, vandalism, or other causes within 72 hours following request for same. Fee for providing estimate will be at the contractors prevailing hourly rate and will be included in the estimate. f. SA day OfÞf1~~ , 1978, by and between Traffic Signal Control Company, a Corporation, of Mesquite, Texas, hereinafter called CONTRACTOR, and the City of North Richland Hills, Texas, a home rule municipal corporation, acting by and through its Mayor, Dick Faram, heretofore fully authorized to act by virture of a Resolution passed by the City Council on the 25th day of September , 1978, hereinafter called CITY, withnesseth: The Parties herby mutually agree to the terms and conditions contained in the memorandum attached hereto as Exhibit "A".
